Did You Know (DYK) Blog Series: Naming the Drug of Drug-Impaired Drivers

Did you Know

Did You Know: – Law enforcement cannot arrest a driver who is obviously impaired without being able to name the drug impairing the driver!  New York’s law is broken.

Four fatalities in August were members of the same family who were stopped at a traffic light at 7:20 p.m. on Sunday evening, August 6.  It is alleged a grossly speeding driver slammed into the family’s car, killing the Marine veteran/Dad, his 13 year old daughter, his 10 year old son, and his six year old granddaughter. The driver was not immediately arrested.

Workarounds had to be devised to get blood by means outside the drugged driving statute.  Toxicology allegedly  showed the driver had fentanyl and cocaine in his bloodstream.
